We are called upon, from time to time, to assist our clients in connection with the foreclosure of liens affecting real property and to resolve other real estate disputes. One typical scenario involves a contract dispute where our client is either seeking to enforce a contract for the purchase of real property or is in a situation where it appears that the contract is no longer in effect or otherwise unenforceable.
Often our work in this connection involves the issue of “expunging” (removing) a lis pendens (notice of pending action) that is tying up a parcel of real property so as to put a cloud on title. We have represented both buyers and sellers in such scenarios.
We also have substantial experience in selling residential real estate pursuant to writ of execution, a particularly complicated process when the judgment debtor is also the owner-occupier of the property.
